Duke Gerstel Shearer, LLP Obtains Largest Construction Site Injury Verdict In Arizona
Partner Ron Green successfully tried to verdict what is believed
to be the largest reported construction site personal injury verdict in
Arizona history for the type of injuries alleged by two journeymen
construction workers who were injured when their scaffolding unexpectedly
fell while they were working on a new commercial high-rise office tower in
Phoenix. The last settlement offer by Defendants' and their insurance
carriers on the day of trial was $50,000.00 per plaintiff. After three (3)
weeks of trial, the jury returned a verdict for $3,312,322.00 plus attorneys
fees, costs, interest, and penalties for denying plaintiffs pre-trial
statutory settlement demand. After months of protracted post-trial motions,
and a lengthy and contentious appeal, the defendants finally ended the
appeals process and handed over checks totaling $3,900,000.00 in April of
2004. This result represents the culmination of nearly five years of
hard-fought litigation and another victory for the clients of DGS. DGS is
